Ano Ang Parusa Sa Pagnanakaw Ng Identity Sa Facebook?

ANG PAGGAMIT NG PICTURE AT NAME SA FACEBOOK NG IBANG TAO O TINATAWAG NA ‘COMPUTER IDENTITY THEFT’ AY ISANG KRIMEN NA MAY PARUSANG KULONG UNDER REPUBLIC ACT NO. 10175 OTHERWISE KNOWN AS “CYBERCRIME PREVENTION ACT OF 2012. KUNG ANG COMPUTER IDENTITY THEFT AY WALANG DAMAGE NA NATAMO, ANG PARUSANG KULONG AY MABABA NG ISANG DEGREE.

Maraming tao ang gumamit ng Facebook at dahil madali makakuha ng picture, may mga kumukuha ng picture ng ibang tao para palabasin na sila yon. May kaso ba ito? Ganito ang problem ng isang reader ng E-Lawyers Online:

“Atty., isa akong online seller at may kumuha sa aking picture at nilagay niya sa profile pic niya para malito mga suki ko at makausap at masulot niya. Kilala ko siya at ayaw nya tumigil. Paano kasuhan siya atty?”

“Hi po, magandang buhay atty. Nasa networking po ako at may gumagamit ng name at profile pic sa Facebook para magrecruit. Karibal ko siya pero tuloy pa rin siya. Ano kaso pwede atty?”

Noong July 25, 2011 ay pinasa ng Kongreso ang Republic Act No. 10175 o ang “Cybercrime Prevention Act of 2012″ kung saan ang pagnanakaw ng computer identity ay pinaparusahan ng kulong:

Section 4. Cybercrime Offenses. — The following acts constitute the offense of cybercrime punishable under this Act:

(b) Computer-related Offenses:

(3) Computer-related Identity Theft. – The intentional acquisition, use, misuse, transfer, possession, alteration or deletion of identifying information belonging to another, whether natural or juridical, without right: Provided, That if no damage has yet been caused, the penalty imposable shall be one (1) degree lower.

Malinaw sa nasabing batas na ang sinumang tao na gumamit ng anumang identifying information ng ibang tao na walang karapatan siya dito ay isang krimen. Ang mga computer identifying information ayon sa American law kung saan patterned ang ating batas, o tinatawag na “personally identifiable information (PII), or sensitive personal information (SPI)” as per NIST Special Publication 800-122 as “any information about an individual maintained by an agency, including (1) any information that can be used to distinguish or trace an individual’s identity, such as name, social security number, date and place of birth, mother’s maiden name, or biometric records; and (2) any other information that is linked or linkable to an individual, such as medical, educational, financial, and employment information.”

Ang parusang kulong sa krimen na computer identity theft ay may range na 6 years and 1 day to 12 years ayon sa Section 8 ng nasabing batas.

Section 8. Penalties. — Any person found guilty of any of the punishable acts enumerated in Sections 4(a) and 4(b) of this Act shall be punished with imprisonment of prision mayor or a fine of at least Two hundred thousand pesos (PhP200,000.00) up to a maximum amount commensurate to the damage incurred or both.
