MAY MATATANGAP BA AKONG SEPARATION PAY PAG NAGFILE AKO NG RESIGNATION LETTER?”
ANG ISANG EMPLEYADO NA NAGFILE NG RESIGNATION LETTER SA TRABAHO NG KUSANG LOOB AT WALANG PAMIMILIT AY WALANG KARAPATAN NA HUMINGI NG SEPARATION PAY EXCEPT KUNG MAY OBLIGASYON ANG EMPLOYER NA BIGYAN SIYA SA KANILANG EMPLOYMENT CONTRACT O COLLECTIVE BARGAINING AGREEMENT O ITO AY MATAGAL NA GINAGAWA NG EMPLOYER AS COMPANY POLICY AND PRACTICE.
May mga kababayan tayo na nagtanong tungkol sa pagreresign sa kumpanya at karapatan sa separation pay. Ganito ang tanong ng isang reader ng E-Lawyers Online:
“Hello po atty., four years na po ako sa kumpanya pero nagsasawa na po ako at balak ko na magfile ng resignation letter at lumipat. meron po ba ako matatanggap na separation pay sa 4 years ko na stay sa kumpanya?”
Ayon sa Labor Code of the Philippines, ang employee ay pwedeng mag-resign sa kanyang trabaho at ang employer ay hindi siya pwedeng pilitin na magtrabaho. Ito ay nasa Article 285 ng Labor Code:
ART. 285. Termination by employee. – (a) An employee may terminate without just cause the employee-employer relationship by serving a written notice on the employer at least one (1) month in advance. The employer upon whom no such notice was served may hold the employee liable for damages.
(b) An employee may put an end to the relationship without serving any notice on the employer for any of the following just causes:
1. Serious insult by the employer or his representative on the honor and person of the employee;
2. Inhuman and unbearable treatment accorded the employee by the employer or his representative;
3. Commission of a crime or offense by the employer or his representative against the person of the employee or any of the immediate members of his family; and
4. Other causes analogous to any of the foregoing.
Ang tawag sa termination ng employment ng isang empleyado ay “resignation”.
May matatanggap ba na separation pay ang isang empleyado na kusang loob na nagresign?
Wala. Ayon sa Supreme Court [Virjen Shipping Corporation v. Barraquio, G.R. No. 178127, April 16, 2009, 585 SCRA 541, 548] Resignation is defined as the voluntary act of an employee who finds himself in a situation where he believes that personal reasons cannot be sacrificed in favor of the exigency of the service and he has no other choice but to disassociate himself from his employment.
Ayon sa Korte Suprema [Hinatuan Mining Corporation v. NLRC, 335 Phil. 1090, 1093-1094 (1997)] “In fact, the rule is that an employee who voluntarily resigns from employment is not entitled to separation pay, except when it is stipulated in the employment contract or CBA, or it is sanctioned by established employer practice or policy.”
Ibig sabihin, kung kusang loob na nagresign ang isang empleyado, wala siyang matatanggap na separation pay except kung ito ay nakalagay sa employment contract niya o kaya sa collective bargaining agreement kung may union ang kumpanya o kaya ang pagbibigay nito sa resigning employee ay establsihed at long period of practice and policy na ng kumpanya.
