Ang Homosexuality Ba Ay Maaarin Magamit Sa Pagsampa ng Annulment of Marriage?

ANG PAGTATAGO NG HOMOSEXUALITY O LESBIANISM BAGO IKASAL NA ISANG PANLOLOKO O FRAUD ANG PWEDENG GAMITIN NA GROUND FOR ANNULMENT OF MARRIAGE. KUNG HOMOSEXUALITY O LESBIANISM AY HAYAGAN AT MAY KAALAMAN ANG PAREHONG PARTIODS NA IKAKASAL AT NAGPAKASAL PA RIN SILA, HINDI ITO MAGAGAMIT NA GROUND SA ANNULMENT OF MARRIAGE. 

Marami tayong mga friends na nagtatanong sa E-Lawyers Online tungkol sa pakikipagrelasyon ng mga mister o misis nila sa same sex after sila ikasal. Ang usual na tanong nila ay kung magagamit ba ito sa annulment of marriage. Ganito ang tanong ng isang reader ng E-Lawyers Online:

“Atty., ang misis ko po ay nasa Saudi at may kalive-in po siya ngayon doon na lesbian. Lumalabas po na lesbian na rin siya. Pwede ko po ba magamit ito sa pagpapa-annul ng kasal?”

“God bless po atty., nag-abroad po ang mister ko sa Middle East pero pagbalik po niya ay nagbago na siya. Nadiscover ko po na may karelasyon na siya ngayon na kapwa niya lalaki na kasama sa work. GUsto ko po mapawalang bisa ang kasal namin gamit po ang ebidensiya na yon. Thanks. Ok po kaya yon?”

Isa sa essential requirement ng isang kasal ay ang legal consent ng mga kinasal na boluntaryo at malaya na binigay. Ngunit ang Family Code ay nagbibigay ng pagkakataon sa isang kinasal na ito ay ipawalang bisa sa korte kung ang kanyang consent sa pagpapakasal ay depektibo dahil merong fraud o panlolokong naganap bago o habang sila ay kinakasal.

Ayon sa Article 45 ng Family Code, ang isang kasal na naganap sa mag-asawa kung saan ang isa sa kanila ay gumamit ng panloloko ay pwedeng gamitin na ground sa annulment of marriage. Ang paggamit ng fraud o panloloko (Article 45, 46 and 47 of Family Code) upang makuha ang consent sa pagpapakasal ay isa ring ground ng annulment of marriage, pero ang batas ay nilimitahan ang “panloloko” at applicable lamang ito sa mga panloloko kung saan itinago ang kabaklaan/homosexuality o lesbianism/pagkatomboy ng asawa na meron siya sa time ng marriage o kasal nila. Ang pagtatago ng homosexuality o lesbianism ang pwedeng ground for annulment of marriage. Wala nang iba pang klase ng “panloloko” ang pwedeng magamit bilang ground sa annulment tulad ng panloloko sa karakter, kalusugan, ranggo, kayamanan o kalinisan ng puri. Ngunit ang ganitong “fraud” o “panloloko” bilang ground sa annulment ay hindi na rin pwedeng gamitin kung meron nang buong kaalaman o nadiskubre niya ang mga nasabing problema ng asawa bago pa lamang sila ikasal at kahit alam niya ang nasabing kabaklaan/homosexuality o lesbianism/pagkatomboy ay dumiretso siya sa pagpapakasal dito at siya ay malayang nakisama dito bilang asawa ay hindi na ito pwedeng gamiting ground sa annulment of marriage.

Art. 45. A marriage may be annulled for any of the following causes, existing at the time of the marriage:

(1) That the party in whose behalf it is sought to have the marriage annulled was eighteen years of age or over but below twenty-one, and the marriage was solemnized without the consent of the parents, guardian or person having substitute parental authority over the party, in that order, unless after attaining the age of twenty-one, such party freely cohabited with the other and both lived together as husband and wife;

(2) That either party was of unsound mind, unless such party after coming to reason, freely cohabited with the other as husband and wife;

(3) That the consent of either party was obtained by fraud, unless such party afterwards, with full knowledge of the facts constituting the fraud, freely cohabited with the other as husband and wife;

(4) That the consent of either party was obtained by force, intimidation or undue influence, unless the same having disappeared or ceased, such party thereafter freely cohabited with the other as husband and wife;

(5) That either party was physically incapable of consummating the marriage with the other, and such incapacity continues and appears to be incurable; or

(6) That either party was afflicted with a sexually-transmissible disease found to be serious and appears to be incurable. (85a)

Art. 46. Any of the following circumstances shall constitute fraud referred to in Number 3 of the preceding Article:

(1) Non-disclosure of a previous conviction by final judgment of the other party of a crime involving moral turpitude;

(2) Concealment by the wife of the fact that at the time of the marriage, she was pregnant by a man other than her husband;

(3) Concealment of sexually transmissible disease, regardless of its nature, existing at the time of the marriage; or

(4) Concealment of drug addiction, habitual alcoholism or homosexuality or lesbianism existing at the time of the marriage.

Kung kayo ay ikinasal ng meron pagtatago ng kabaklaan/homosexuality o lesbianism/pagkatomboy, ang inyong kasal ay invalid at ito ay pwedeng gamiting ground sa annulment of marriage pero kailangan nyo nang i-file ang annulment sa loob ng five (5) years mula sa pagkadiskubre ng “panloloko”. Ngunit kung ang homosexuality o lesbianism ay lumabas lamang o nagsimula lamang pagkatapos ng kasal o kaya ito ay hindi naman itinago, hindi ito pwedeng gamitin na ground for annulment of marriage pero pwede itong gamitin na ground sa legal separation.

Art. 55. A petition for legal separation may be filed on any of the following grounds:

(1) Repeated physical violence or grossly abusive conduct directed against the petitioner, a common child, or a child of the petitioner;

(2) Physical violence or moral pressure to compel the petitioner to change religious or political affiliation;

(3) Attempt of respondent to corrupt or induce the petitioner, a common child, or a child of the petitioner, to engage in prostitution, or connivance in such corruption or inducement;

(4) Final judgment sentencing the respondent to imprisonment of more than six years, even if pardoned;

(5) Drug addiction or habitual alcoholism of the respondent;

(6) Lesbianism or homosexuality of the respondent;

(7) Contracting by the respondent of a subsequent bigamous marriage, whether in the Philippines or abroad;

(8) Sexual infidelity or perversion;

(9) Attempt by the respondent against the life of the petitioner; or

(10) Abandonment of petitioner by respondent without justifiable cause for more than one year.

Kailangan patunayan sa ground na ito na ang kabaklaan/homosexuality o lesbianism/pagkatomboy ay naroon na sa tao bago pa lang sila ikasal at hindi alam ng kanyang asawa at patuloy na naroon pa rin habang nililitis ang annulment of marriage.
