Ano Ang Dapat Gawin Kung Hinaharass Ka Nang Inutangan Mo?

Sino ang nakakaranas ng unfair collection practices ng mga lending companies at credit card companies at ng mga collectors nila dahil sa utang?

Basahin mo ito at i-share sa mga friends para labanan ang pang-aabuso nila!

Ang utang ay utang, at ito ay dapat bayaran ng umutang. Ngunit kung ang pagsingil sa utang ay ginagawa na labag sa batas, ito ay dapat parusahan. May mga maayos na collection agency ngunit mayroon din na lumalabag sa batas at sa karapatang pantao ng mga umutang.

Lets take for example ang isang reader ng E-Lawyers Online na humingi ng tulong dahil umutang siya sa isang online lending app at ng hindi makabayad ay nagpadala ng private message sa lahat ng friends ng borrower. Sa kahihiyan, siya ay nagkaroon ng mental depression.

Isa pang example, isang credit card holder ang hindi nakabayad sa utang dahil sa pagkalugi ng negosyo. Tinawagan siya ng collection agency at nagtext at sinabi na siya ay may kasong Estafa sa korte at meron na itong warrant of arrest at writ of execution para kunin ang mga properties sa bahay niya, na hindi naman totoo. Sa takot, siya nastroke at ngayon ay naging doble ang problema.

Ang masakit, ang mga collector na ito ay hindi nagpapakilala, o gumagamit ng hindi totoong pangalan o gumagamit ng pangalan ng ibang lawyer o law office para hindi ma-exposed ang kanilang collection agency/law firm at tatawag ng disoras ng gabi o habang ikaw ay nagtratrabaho at isusumbong ka pa sa boss mo at mumurahin ka.

May legal remedy ba laban sa ganitong unfair collection practices ng mga lending companies at credit card companies?

Meron po.

Alamin muna natin kung saan ka dapat magreklamo laban sa ganitong unfair collection practices ng mga lending companies at credit card companies.

Kung ang unfair collection practices ay ginawa ng mga credit companies o ng kanilang collection agencies, sila ay dapat ireklamo sa Bangko Sentral ng Pilipinas (BSP)

The Bangko Sentral ng Pilipinas issued BSP Circular No. 454 at “Manual of Regulations for Non-Bank Financial Institutions” (MORNBFI, Subsections 4320Q.14, page 136, and 4301N.14, page 810) classifies the following as unfair collection practices:

1. The use or threat of violence or other criminal means to harm the physical person, reputation, or property of any person;

2. The use of obscenities, insults, or profane language which amount to a criminal act or offense under applicable laws;

3. Disclosure of the names of credit cardholders who allegedly refuse to pay debts;

4. Threat to take any action that cannot legally be taken;

5. Communicating or threat to communicate to any person credit information which is known to be false, including failure to communicate that a debt is being disputed;

6. Any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a cardholder; and

7. Making contact at unreasonable/inconvenient times or hours which shall be defined as contact before 6:00 A.M. or after 10:00 P.M., unless the account is past due for more than sixty (60) days or the cardholder has given express permission or said times are the only reasonable or convenient opportunities for contact.

Kung ang unfair collection practices ay ginawa ng mga lending companies, katulad ng mga online lending apps at mga lending o financing company, ito ay dapat ireklamo sa Securities and Exchange Commission (SEC).

Sa kasalukuyan, gumawa ang SEC ng draft ng Memorandum Circular laban sa ganitong mga gawain at ito ay paparusahan nila ng fine P25,000 and P50,000 pesos, sa first offense.

Sa second offense ay fine of P50,000 and P100,000, respectively at sa third offense will be penalized with the suspension or revocation of the corporation’s Certificate of Authority to Operate.
